Agreement to Terms
By accessing our website, engaging our services, or entering into any agreement with Elastidev (“we,” “our,” or “us”), you (“client,” “you,” or “your”) agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
Services Provided
Elastidev provides web development, design, hosting, maintenance, and related digital services including but not limited to:
- WordPress website development and customization
- Website hosting and maintenance services
- Search engine optimization (SEO) services
- Website performance optimization
- Technical support and consulting
- White-label development services
Service Packages and Pricing
Productized Service Tiers
- Starter Template: $2,500 – Pre-built templates with 1-year hosting and maintenance
- Foundation Website: $7,000-$9,000 – Semi-custom builds with component library
- Professional Website: $14,000-$20,000 – Full custom builds with advanced features
- E-Commerce Build: $22,000-$37,000 – Complete WooCommerce solutions
Additional Services
- Hourly development work: $125-$150 per hour
- Monthly maintenance plans: Starting at $200/month
- Custom quotes for enterprise projects
Payment Terms
Project Payments
- Deposit: 50% deposit required to begin work
- Final Payment: Due upon project completion and before launch
- Monthly Services: Billed monthly in advance
- Hourly Work: Invoiced weekly or bi-weekly
Payment Methods
We accept payments via bank transfer, credit card, and other approved methods. Late payments may incur a 1.5% monthly service charge.
Overdue Accounts
Accounts overdue by 30 days may result in suspension of services. We reserve the right to pursue collection of overdue amounts, including reasonable attorney fees and costs.
Refund Policy
All refund requests are evaluated on a case-by-case basis. Factors considered include:
- Work completed and delivered
- Time and resources invested
- Reason for refund request
- Stage of project completion
Generally, deposits are non-refundable once work has commenced. Monthly services may be cancelled with 30 days notice, with no refunds for partial months.
Project Scope and Changes
Scope Definition
Project scope will be clearly defined in writing before work begins. All projects include the specific deliverables outlined in your service package or custom proposal.
Scope Changes
Changes to project scope after commencement will be billed separately at our standard hourly rates. Significant scope changes may require a new timeline and additional payment.
Client Responsibilities
Clients are responsible for:
- Providing timely feedback and approvals
- Supplying content, images, and materials
- Making timely payments
- Communicating requirements clearly
- Providing access to necessary accounts and systems
Intellectual Property
Client Content
You retain ownership of all content, images, and materials you provide. You grant us a license to use these materials for the purpose of completing your project.
Custom Development
Upon full payment, you own the custom code and design elements created specifically for your project. However, we retain rights to:
- General techniques and methodologies
- Reusable code components and libraries
- Template designs used across multiple projects
Third-Party Components
Websites may include third-party themes, plugins, and tools governed by their respective licenses. You are responsible for compliance with these licenses.
Hosting and Maintenance
Hosting Services
Our hosting services include:
- Server management and monitoring
- Regular backups
- Security updates
- Performance optimization
- Technical support
Uptime and Performance
We strive for 99.9% uptime but cannot guarantee continuous availability. We are not liable for damages resulting from temporary outages or performance issues.
Data Backup
We perform regular backups of hosted websites. However, you are ultimately responsible for maintaining your own backups of critical data.
Website Usage and Restrictions
Websites we develop must not be used for:
- Illegal activities or content
- Adult content or pornography
- Hate speech or discriminatory content
- Spam or malicious activities
- Activities that violate third-party rights
We reserve the right to suspend services for violations of these restrictions.
Warranties and Disclaimers
Service Warranty
We warrant that our services will be performed in a professional manner consistent with industry standards. We will correct any material defects in our work at no additional charge within 30 days of project completion.
Disclaimers
EXCEPT AS EXPRESSLY STATED, ALL SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Limitation of Liability
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR:
- INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
- LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
- DAMAGES RESULTING FROM THIRD-PARTY ACTIONS
- DAMAGES BEYOND OUR REASONABLE CONTROL
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:
- Your use of our services
- Content you provide or publish
- Violation of these terms
- Infringement of third-party rights
Termination
Termination by Client
You may terminate services with 30 days written notice. You remain responsible for payment of all work completed and expenses incurred.
Termination by Elastidev
We may terminate services immediately for:
- Non-payment of fees
- Violation of these terms
- Abusive or inappropriate conduct
- Illegal use of our services
Effect of Termination
Upon termination, we will provide reasonable assistance in transferring your website and data, subject to payment of all outstanding fees.
Confidentiality
We agree to maintain the confidentiality of your business information and will not disclose confidential information to third parties without your consent, except as required by law or necessary to provide services.
Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, government actions, or other unforeseeable events.
Dispute Resolution

We encourage direct communication to resolve any disputes. Please contact us first to discuss any concerns.
Governing Law
These terms are governed by the laws of the United States and the state where our business is located, without regard to conflict of law principles.
Jurisdiction
Any legal action must be brought in the courts of competent jurisdiction in our business location.
Communication
By engaging our services, you consent to receive communications from us via email, phone, or other electronic means for service-related purposes.
Modifications
We reserve the right to modify these terms at any time. Significant changes will be communicated via email or website notice. Continued use of our services after changes constitutes acceptance of new terms.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These terms, together with any signed service agreements or proposals, constitute the entire agreement between us regarding our services and supersede all prior communications and agreements.
